BM and ENG: Zunar’s statement on MOLpay issue
BACKGROUND
On 17th November 2014, I received an email from MOLPay indicating that they have received a request from PDRM to reveal the details of my customers who have purchased my book through my website www.zunar.my. The request was in lieu with the police investigation being done on me regarding the publishing of my cartoon book titled “Komplot Memenjarakan Anwar” which is being sold on the said website.
After receiving the email, we immediately sent an email to MOLPay seeking further clarification, to no avail. Another email was sent on the 20th November 2014 which still did not receive any feedback. I sent the third email on 26th November 2014, after which we finally heard back from MOLPay. The respondent, Mr. Kam, who is the Head of Operations & Risk Management stated that the decision that contained in the initial email was made by MOLPay’s Customer Care department. However, their management eventually altered the decision.
To answer to my other questions, Mr. Kam indicated that the request by PDRM was made in written form. Regarding the same issue, a website – Cilisos (http://cilisos.my/plot-twist-molpay-did-not-release-political-comic-details-to-pdrm/) reported a statement (via email) from the CEO of MOLPay, Mr. Sheng Gun Eng, informing a contradicting statement of the fact that the the request was made in written form.
In the same report, Sheng denied that they have given such details to the police.
STATEMENT
The statements from both MOLPay officers are doubtful and do not convince me. Firstly, the initial email dated 17th November 2014 that I received, that stated “MOLPay has no choice but to furnish them with the requested details” is an email in the form of statement. This means, there is no single guarantee that the complete list has already been given to the polist.
Therefore, the statement from Kam and Sheng seven days later that indicated that the MOLPay management has changed their decision does not carry any meaning if the information has already been furnished to the police.
Since the inception of this issue last week, I have had to face questions from my customers from all over the country asking whether their personal details will be exposed to the police if they place their purchases from my website. In their (MOLPay) statement, they have failed to answer the most basic and important question – “when the Customer Care made the decision and informed us, was the list of my customer’s names already given to the police?”.
Therefore, as a MOLPay customer, I am claiming from MOLPay to furnish me with:
- A copy of the letter from the police that requests the complete list of my customers.
- A copy of the answer made by MOLPay to the police that states the fact that they denied giving the complete list of my customers to them.
As a customer, I have the right to receive these explanations whether directly to me or I have to extend this to my lawyer.
LATAR BELAKANG
Pada 17 November 2014 saya mendapat surat dari MOLpay yang menyatakan bahawa mereka menerima request dari PDRM untuk mendedahkan nama-nama pelanggan yang membeli buku secara online melalui website saya, www.zunar.my. Permintaan itu adalah sebahagia dari siasatan terhadap saya oleh pihak polis atas penerbitan buku kartun, “Komplot Memenjarakan Anwar” yang dijual melalui wensite tersebut.
Selepas menerima email tersebut, pihak saya segara menghantar email kepada pihak MOLpay meminta penjelasan, namun tiada jawapan segera. Satu lagi email menyusul pada 20 November 2014 juga tidak mendapat jawapan. Saya mengutus email ketiga pada 26 November 2014 dan barulah pihak mendapat jawapan dari pihak MoLpay. Email jawapan dari Encik Kam, iaitu Ketua Operation & Risk Management menyatakan bahawa keputusan yang terkandung dalam email pertama adalah dibuat oleh jabatan Customer Care MOLpay, tetapi pihak pengurusan syarikat tersebut kemudiannya telah mengubah semula keputusan itu.
Dan kepada soalan saya yang lain, Encik Kam menjawab bahawa surat pemintaan dari PDRM tersebut di buat secara bertulis. Berkenaan isu yang sama, sebuah lawan web Cilisos (http://cilisos.my/plot-twist-molpay-did-not-release-political-comic-details-to-pdrm/) melaporkan kenyataan (melalui email) dari CEO MOLPay, Sheng Guan Eng, membuat kenyataan bercanggah dengan menyatakan permintaan dari pihak polis dibuat secara bertulis.
Sheng dalam laporan sama menafikan pihaknya telah memberi maklumat pelanggan saya kepada pihak polis.
KENYATAAN
Kenyataan dari kedua-dua pegawai MOLpay amatlah diragukan dan tidak meyakinkan saya. Pertama, email pertama bertarikh 17 November 2014 yang saya terima yang menyatakan bahawa “pihak MOLpay tidak punya pilihan selain dari menyediakan pihak polis dengan maklumat lengkap” adalah satu email makluman. Ertinya tidak ada satu jaminan bahawa senarai lengkap telah diberi kepada pihak polis.
Kerana itu, kenyataan dari Kam dan Sheng tujuh hari selepas itu yang menyatakan bahawa pihak pengurusan MOLpay telah mengubah keputusan tersebut tidak mempunyai apa-apa makna sekiranya maklumat tersebut telah diberi kepada pihak polis.
Sejak isu ini timbul minggu lepas, saya berhadapan dengan soalan pelanggan-palanggan saya dari seluruh negara yang bertanya apakah data-data peribadi mereka akan terdedah kepada pihak polis sekiranya mereka membuat pembelian dari laman web saya. Dalam kenyataan mereka, pihak MOLpay gagal menjawab soalan paling asas dan penting – apakah ketika Customer Care membuat keputusan dan memaklumkan kepada pihak kami, nama-nama pelanggan saya telah diberi kepada pihak polis?
Kerana itu, sebagai pelanggan MOLpay, saya menuntut supaya pihak MOLpay memberi kepada saya:
- Salinan surat polis kepada mereka yang menuntut maklumat lengkap pelanggan-palanggan saya.
- Salinan jawapan pihak MOLpay kepada pihak polis yang menyatakan mereka enggan memberi senarai lengkap pelanggan-pelanggan saya.
Sebagai pelanggan, saya berhak mendapat penjelasan ini sama ada melalui jawapan terus kepada saya, atau saya terpaksa panjangkan ia kepada peguam saya.
