Sedition Act: Federal Court ruling disappointing, politically motivated

The ‘approval’ of the Sedition Act by the Federal Court is totally disappointing, unacceptable and undemocratic. On 5th of October, the Federal Court, challenged by law professor Azmi Sharom, ruled that the Sedition Act 1948 remains constitutional and a valid piece of legislation. Azmi had argued that the Sedition Act 1948 is not a valid law as it was not enacted by Parliament and contradicted with the Article 10 of the Federal Constitution.

Article 10 of the Constitution of Malaysia stated clearly, that “(a) every citizen has the right to freedom of speech and expression; (b) all citizens have the right to assemble peaceably and without arms.”

Thus, the decision by the court simply mocked the Constitution and politically motivated. Since it was introduced in 1948, the Sedition Act was used as a powerful weapon by the government to constrain and curtail freedom of expression in Malaysia. More than 200 activists – students, lecturers, lawyers, writers, religious activists, opposition leaders and cartoonist had either been arrested, detained, investigated or charged since last year. As it is, I am now being slapped with 9 charges under the draconian act and facing a possible 43 years of jail term and the proceeding has been set for 6th November.

The decision by the Federal Court gives more mandate for the government to continue to use the Sedition Act against dissidents. The hope to get justice from the court is just fairy tale. More sedition case will be opened. The space for freedom of speech and expression will become narrow. Malaysia in now sprinting backward. Prime Minister Najib is now heading toward “Mugabeism.”

I would like to suggest that the Federal Constitution of Malaysia to be exhibited nicely at the museum as collector’s item.

Akta Hasutan: Keputusan Mahkamah Persekutuan mengecewakan, bermotif politik

Keputusan Mahkamah Persekutuan yang mengesahkan penggunaan Akta Hasutan adalah mengecewakan, tidak boleh diterima dan tidak demokratik. Pada 5

Oktober lepas, Mahkamah Persekutuan dalam kes melawan Professor Undang-Undang, Azmi Sharom membuat keputusan bahawa Akta Hasutan adalah sah dari segi Perlembagaan. Azmi sebelum itu mencabar kesahan akta tersebut kerana ia bertentangan dengan Artikel 10 Perlembagaan Persekutuan yang menjamin kebebasan bersuara.

Artikel 10 menyatakan dengan jelas bahawa. “(a) Tiap-tiap warganegara adalah berhak bebas bercakap dan mengeluarkan fikiran; (b) Semua warganegara adalah berhak berhimpun secara aman dan dengan tidak bersenjata.”

Dengan itu, keputusan mahkamah ini jelas memperlekeh Perlembagan dan bermotif politik. Sejak diperkenal dalam tahun 1948, Akta Hasutan digunakan sebagai senjata politik berkesan parti pemerintah untuk mengekang kebebasan bersuara. Lebih 200 aktivis terdiri dari mahasiswa, pensyarah, peguam, penulis, agamawan, pemimpin pembangkang dan kartunis telah disiasat, ditangkap, ditahan atau dibicarakan di bawah Akta Hasutan sejak tahun lepas. Saya sendiri sedang menghadapi 9 tuhduhan di bawah Akta Hasutan yang membawa hukuman maksima secara matematik 43 tahun dan kes saya akan berlangsung pada 6 November depan.

Dengan keputusan ini, mahkamah memberi lebih mandat kepada kerajaan untuk terus menggunakan Akta Hasutan terhadap pengkritik. Harapan untuk mendapat keadilan dari mahkamah telah musnah. Kes-kes Akta Hasutan yang tertangguh sebelum ini akan dibuka semula. Ia akan menyempitkan lagi ruang kebebasan bersuara dan berekspresi yang sudah sangat terhad di Malaysia. Malaysia sekarang sedang memecut ke belakang. Perdana Menteri Najib sedang menuju era ‘Mugabe-risma.’

Saya cadangkan Perlembagaan Persekutuan di masukkan ke muzium untuk dijadikan pameran barang antik.
